How Much Can a Landlord Charge for a Security Deposit in Pennsylvania?

How Pennsylvania Security Deposit Limits Work
Pennsylvania has a unique sliding-scale security deposit limit that changes based on how long you've lived in the unit. Under 68 P.S. § 250.511a, landlords may collect a maximum of two months' rent as a deposit during the first year of tenancy. Starting in the second year, the cap drops to one month's rent — and the landlord must refund the excess within 30 days of the anniversary.
After five years of continuous tenancy, the landlord is prohibited from increasing the deposit amount at all, even if rent increases. The return deadline is 30 days after the lease ends, and the landlord must provide an itemized list of any deductions. Failure to return the deposit within 30 days entitles the tenant to double (2×) the amount wrongfully withheld.
Pennsylvania also requires that deposits be held in an escrow account at a federally or state-regulated institution. After the first 24 months of tenancy, the tenant becomes entitled to interest on the deposit at the actual rate earned by the bank (landlord may retain 1% annually as an administrative fee).

In the first year of tenancy, a PA landlord can collect: first month's rent (always permitted), plus a security deposit of up to two months' rent. There is no statutory provision for collecting "last month's rent" separately in Pennsylvania. So the maximum at signing in Year 1 is: first month + two months deposit = three months' rent total. Starting in Year 2, the deposit cap drops to one month, and the landlord must refund the excess.
When does the Pennsylvania deposit limit decrease from 2 months to 1 month? ▼
The cap drops to one month's rent at the start of your second year of tenancy (month 13). The landlord must refund the excess portion within 30 days of your one-year anniversary. If they don't, they are in violation of 68 P.S. § 250.511a and you may be entitled to double (2×) damages.
Do I earn interest on my Pennsylvania security deposit? ▼
