Template 1: Security Deposit Return Demand

Use this letter if your landlord has not returned your deposit after the state deadline.

Subject: Formal Demand for Return of Security Deposit Dear [Landlord Name], I am writing to formally request the immediate return of my security deposit in the amount of $[Deposit Amount]. I vacated the premises at [My Address] on [Move-out Date] and left the property in excellent condition. Under state law, you are legally required to return my deposit or provide an itemized list of specific deductions within [State Return Deadline] days of my move-out. That statutory deadline has now passed, and I have not received the funds nor a valid accounting of deductions. Please send the full deposit amount to my new forwarding address: [New Address] within 5 business days. Failure to comply may result in further legal action in small claims court, where I may be entitled to recover the deposit plus statutory penalty damages and court costs.

Template 2: Illegal Late Fee Challenge

Use this letter to reject a late fee that exceeds statutory limits or violates the mandatory grace period.

Subject: Notice Regarding Unlawful Late Fee Assessment Dear [Landlord Name], I am writing regarding the late fee of $[Late Fee Amount] assessed to my account for the rental period of [Month]. Under our state's tenant protection laws, landlords are strictly prohibited from charging late fees that exceed [State Max Fee Limit]. Furthermore, state law mandates a mandatory grace period of [Late Fee Grace Period] days before any penalty can be legally applied. The fee you have attached to my ledger exceeds these legal limits. I have paid my base rent of $[Base Rent Amount] in full. Please adjust my account ledger immediately to remove this unlawful late fee to ensure we remain in compliance with state housing regulations.

How to Send a Demand Letter

Always send demand letters to your landlord via Certified Mail with Return Receipt Requested or through a method that provides proof of delivery. Keep a physical copy of the signed letter and the postal receipt for your records in case you need to present them in court.
